Privacy Policy

§ 1 General

Your personal data (e.g. title, name, address, email address, phone number, bank details, credit card number) are processed by us only in accordance with the provisions of German data protection law and the data protection law of the European Union (EU). The following regulations inform you about the purposes of processing, legal bases, recipient categories, storage periods, as well as your rights and the controller responsible for your data processing. You can inform yourself about how Kfz-Anlasser handles your data using Kfz-Anlasser's privacy policy.

(2) Hosting: We host our website at Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen. Hetzner stores server log files (e.g. IP address, browser type, date/time) to ensure technical operation. We have concluded a data processing agreement (DPA) with Hetzner in accordance with Art. 28 GDPR.

§ 2 Data processing for contract fulfillment

(1) Purpose of processing: Your personal data that you provide to us in the ordering process are required for concluding a contract with us. You are not obliged to provide your personal data. However, without providing your address, we cannot send you the goods. For some payment methods, we require the necessary payment data to pass them on to a payment service provider commissioned by us. The processing of your data entered in the ordering process therefore takes place for the purpose of contract fulfillment.

(2) Legal basis: The legal basis for this processing is Art. 6 Para. 1 b) GDPR.

(3) Recipient categories: Shipping: We pass your address to shipping providers (e.g. DHL, DPD, GLS). Payment: Your payment data is transmitted to the chosen payment service provider (e.g. PayPal). Other recipients: possibly merchandise management systems, suppliers (dropshipping). Note: All transactions of the payment service provider PayPal are subject to the PayPal privacy policy.

(4) Storage duration: We store the data required for contract processing until the expiry of the statutory warranty and, if applicable, contractual guarantee periods. We retain the data required by commercial and tax law for the legally determined periods, regularly ten years (cf. § 257 HGB, § 147 AO).

§ 3 Newsletter

(1) Purpose of processing: Upon separate registration for our newsletter, your email address will be used for our own advertising purposes with your consent. For registration, you have given the following consent: Subscribe to 'General' newsletter from Kfz-Anlasser.

(2) Legal basis: The legal basis for this processing is Art. 6 Para. 1 a) GDPR.

(3) Storage period: Your email address will only be stored for this purpose as long as the newsletter subscription is active.

(4) Right of withdrawal: You can unsubscribe from the newsletter at any time in My Kfz-Anlasser under 'Preferred Sellers' and thus revoke your consent to the processing of your email address for advertising purposes with effect for the future.

§ 4 Your rights as a data subject

If personal data is processed by you, you are a data subject within the meaning of the GDPR and you have the following rights towards us as the controller:

a) General: justified objection required. If the processing of personal data concerning you takes place to safeguard our overriding legitimate interest (Art. 6 Para. 1 f) GDPR) or in the public interest (Art. 6 Para. 1 e) GDPR), you have the right to object to the processing at any time for reasons arising from your particular situation; this also applies to profiling based on the provisions of the GDPR.

In the event of an objection, we will no longer process the personal data concerning you unless we can prove compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

b) Special case of direct advertising: simple objection sufficient. If the personal data concerning you are processed in order to operate direct advertising, you have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising; this also applies to profiling insofar as it is associated with such direct advertising. If you object to the processing for direct advertising purposes, the personal data concerning you will no longer be processed for these purposes.
